If I understand correctly, it's even worse than that: firmware update or not, Ledger _always_ had the capability to _physically_ export private keys. The capability was always there, and it was blocked by a mere piece of software (proprietary software, too). So Ledger was never a hardware wallet, it was a soft wallet. Even if you don't update the firmware. In a true hardware wallet the portion of the firmware responsible for direct contact with the private keys should be on a _read-only_ chip, so that no firmware update, ever, could change it. I think this is the problem, and avoiding this firmware update changes nothing.
